Injunctions
A topic that has hit the headlines in recent weeks is that of the so-called super injunction. The battle between the Right to the Respect of Private and Family Life and the Right of Freedom of Expression is controversial as a balance needs to be sought between the media and private individuals or companies.
Although these super injunctions have received a lot of press coverage,despite the fact that even the existence of them is not meant to be reported, they are rarely used and they are also not the only type of injunctions.
Injunctions can come in a number of forms from prohibitory and mandatory injunctions to the more draconian remedy of freezing injunctions. Where a prohibitory injunction can be used to prevent a party from doing something, such as restricting a former employee from setting up a rival company, a freezing injunction can prevent a party from removing or dealing with any assets located within England and Wales and, with regards to a worldwide freezing injunction, any assets outside of England and Wales. This can be seriously inconvenient to any person or company subject to such an injunction and so a strong cause of action is required to obtain one.
